We write further to your request which was received on 21 February 2019 and which states: "A list of Planning Appeal Numbers of decisions of the DEFA Minister on Planning Appeals from February 2012 to date where either the Inspector’s recommendation or the Minister’s decision were referenced to, or influenced by, the 2012 Draft Planning Policy Statement - Planning and the Economy."
While our aim is to provide information whenever possible, in this instance the Cabinet Office does not hold the information that you have requested. The Cabinet Office does not hold a list detailing Planning Appeal decisions that have referenced or been influenced by the Draft Planning Policy Statement – Planning and the Economy. The Cabinet Office would have create such a list by reviewing the information held for over 700 Planning Appeals to create such a list. Section 8(3)(c) of the Freedom of Information Act 2015 states that nothing in the Act requires the public authority to undertake substantial compilation or collation of information that it holds. To provide advice and assistance, please find enclosed a list of all Planning Applications that have gone to Appeal from 1 May 2011 to date: for both Hearings and Written Representations. The Application numbers submitted and dated prior to February 2012 have been included as these Appeals were not determined by the Minister until after February 2012. You will be able to review all documentation (including Inspector’s reports and recommendations and Ministerial decisions) for all Appeals online at https://services.gov.im/planning-applications/ and ascertain those where the Inspector’s recommendation or the Minister’s decision referenced or was influenced by the Draft Policy Statement. For your reference the Draft Planning Policy Statement can be found on the Planning and Building Control Website here: https://www.gov.im/media/633683/draftppsplanningtheeconomy1.pdf.
