We write further to your request which was received on 12 February 2019 and which states:
"Please can I have copies, of upheld parking disc queries for failing to display a disc in a disc zone for the years 2014/2015, 2015/2016, 2016/2017 and 2017/2018. Clarification: I am just seeking the information where the penalty was dismissed. I would like photocopies of the correspondence however all I would like are the original appeal, the final decision and the reasons for the decision"
While our aim is to provide information whenever possible, in this instance the public authority does not hold or cannot, after taking reasonable steps to do so, find some of the information that you have requested. This is because our retention period for appeals is 12 months. Therefore, we can only source correspondence dating back to January 2018. I am pleased to provide information below and in the accompanying appendices (which have been split into multiple documents because of file size restrictions). For the offence of failing to display a disc, in 2017/18 125 fixed penalties were cancelled and in the period January to February 2019 69 penalties have been cancelled. We attach documents as requested. Please note that any operational information in emails or documents, which does not pertain to your request, has been redacted. In addition, some information has been redacted under Section 25 of the Act (absolutely exempt personal information). The reasons why that exemption applies are that the Department of Infrastructure (DOI) is satisfied that the information amounts to personal data under the Data Protection Act 2002. The DOI is satisfied that disclosure of the information would contravene one of the data protection principles, namely that DOI can only disclose the information where it would be fair, lawful and meet one of the conditions in schedule 2 and in this case, none of those conditions have been met.
