Dear ###,

We write further to your request which was received on 11 September 2018 and which states:

"I would be grateful for all IOM Arts Council Funding Decisions for the present financial year (i.e. 2017-2018 to date), 2016-2017, and 2015-2016, relating to the Performing Arts."

Our response to your request is as follows:

While our aim is to provide information whenever possible, under section 20 of the Act, we are not required to provide information in response to a request if it is already reasonably accessible to you, whether free of charge or on payment of a fee. Some of the information that you have requested is already available on the Freedom of Information disclosure log under the Department’s name.
By way of advice and assistance this can be found under response reference 366459 titled ‘Arts Council Funding Awards’, dated 16th April 2018 (request submitted 19th March 2018). Alternatively if you type the keyword ‘Arts’ into the search box at https://services.gov.im/freedom-of-information/search this will locate relevant search results for published responses. The remainder of the information you have requested is attached, which details the approved IOM Arts Council funding applications relating to the performing arts up until the date of your request.
However please note that some information within the attached table (specifically the names of individuals) has been redacted. This is because the Department is satisfied that the redacted information amounts to personal data under the Data Protection Act 2002 which is absolutely exempt from disclosure under section 25 (exempt personal information) of the Freedom of Information Act (the Act). The redacted content constitutes personal data and we do not have the express permission to publicly disclose this information, nor can we do so without such permission as the conditions in Schedule 2 of the Data Protection Act are not met. To

do so would result in a contravention of the data protection principles, as publication permission in respect of personal data has not been obtained. Please quote the reference number 592234 in any future communications.

If you are not satisfied with the result of the review, you then have the right to appeal to the Information Commissioner for a decision on; 1. Whether we have responded to your request for information in accordance with Part 2 of the Freedom of Information Act 2015; or 2. Whether we are justified in refusing to give you the information requested.
In response to an application for review, the Information Commissioner may, at any time, attempt to resolve a matter by negotiation, conciliation, mediation or another form of alternative dispute resolution and will have regard to any outcome of this in making any subsequent decision. More detailed information on your right to a review can be found on the Information Commissioner’s website at www.inforights.im.
