c Road Races Act 2016 MANX GRAND PRIX & CLASSIC T.T. ROAD RACES AUTHORISATION 2018 Made:

Coming into Operation: 17 August 2018 The Department of Infrastructure gives the following authorisation under sections 5 to 7 of the Road Races Act 2016. 1 Title This Authorisation is the Manx Grand Prix & Classic T.T. Road Races Authorisation 2018. 2 Grant of Authorisation This Authorisation is given by the Department to Manx Motor Cycle Club Ltd (in its capacity as organiser) for the use of the road or roads specified in Schedule 1 for the purposes of racing in accordance with its terms. 3 Interpretation In this Authorisation— “Act” means the Road Races Act 2016; “closure period” means a period during which the course or part of the course is authorised for use for a race in accordance with article 4; "competing vehicle" means the motor cycles, with or without a sidecar, authorised to participate in a race; “course” means the road or roads authorised to be used for a race in this authorisation other than the parts of those roads specified in Part 2 of Schedule 1 and, for the sake of clarity, includes — (a) any path, way or verge (whether publicly or privately owned) next to or near to a road except where specifically excluded;
(b) a barrier next to or near to a road; any land (whether publicly or privately owned) between the road and such a barrier;

(c) all areas inside or on bus shelters adjacent to a road authorised to be used for racing; and
(d) any roadside gateway, lay-by or parking area adjacent to such a road; “FOM” means the Festival of Motorcycling which includes the Manx Grand Prix and Classic T.T. road races; “FOM period” means the period from and including 17 August 2018 up to and including 3 September 2018; “hazardous area” means the relevant land in respect of section 7(2) and 7(4)(a) of the Act and specified in Part 2 of Schedule 4; ”motor cycle” has the meaning given by section 65 of the Road Traffic Act 1985; “motor vehicle” has the meaning given by section 65 of the Road Traffic Act 1985; “pedestrian” includes wheelchair users and any persons using another mobility aid other than a bicycle or motor vehicle; “prohibited area” means an area specified in Schedule 4 as being prohibited; “restricted area” means an area specified in Schedule 4 as being restricted; “senior police officer” means a member of the Isle of Man Constabulary— (a) of the rank of sergeant or above; and (b) authorised by the Chief Constable to act as senior police officer for the purposes of this Authorisation; “side road” means any part of a road that leads onto the course; and “signage” includes any barrier, tape, sign, markings or structure which indicates restricted or prohibited access to the course, a side road, a prohibited area or a restricted area.. 4 Authorisation for use of roads for races (1) The organiser is authorised to use the roads specified in Part 1 of Schedule 1 for races on the days and during the times specified in Schedule 2. (2) The type or types of vehicle that are to participate in the races are motorcycles, with or without a sidecar. 5 Suspension of right of way on the course
During any closure period — (a) the right of way over any part of the course is suspended and no traffic may enter or remain on it; and

(b) no person must enter or remain, or cause or permit any vehicle or animal to enter or remain on any part of a course. This is subject to the exemptions in articles 7 and 8. 6 Regulation of traffic on side roads No person must enter or remain, or cause or permit any vehicle or animal to enter or remain on a side road in contravention of any indication given by signage unless permitted to do so by — (a) a constable; (b) a marshal; or (c) the organiser. This is subject to the exemptions in articles 7 and 8. 7 Exemptions from articles 5 and 6 (1) Articles 5 and 6 do not apply to the following persons— (a) the Clerk of the Course; (b) persons appointed by the organiser as marshals or officials for the purpose of the race in question; (c) persons approved by the Clerk of the Course; (d) constables, fire officers, medical or veterinary personnel, highway maintenance and recovery personnel; (e) persons lawfully taking part in the race in question and any person authorised by the organiser to assist those persons; (f) media representatives, television crews and photographers approved by the organiser and bearing an official badge, armlet or tabard issued by the organiser. (2) An approval given by the organiser to a person in sub-paragraph (1)(f) may include any conditions the person must comply with.
(3) Articles 5 and 6 do not apply to the competing vehicles and any vehicle approved by the Clerk of the Course. 8 Temporary opening of the course to traffic (1) This article has effect despite anything in articles 5, 6 and 7. (2) If a race is temporarily postponed, suspended or in any interval during a closure period, the Clerk of the Course may authorise traffic, in accordance with the directions of a constable or marshal, to cross or proceed along such part of the course, and at such times, as he or she may specify.

(3) Nothing in paragraph (2) permits vehicles to proceed in the reverse direction of the course, except with the express authorisation of the Clerk of the Course. (4) In any interval between races during a closure period, the Clerk of the Course may authorise traffic, in accordance with the directions of a constable or marshal, to cross or proceed along the course at the places specified in Schedule 3, at such times as he or she may specify (5) When traffic is authorised to cross or proceed along the course under sub-paragraph (4), the Clerk of the Course must ensure— (a) that signs are displayed on the course, to indicate to persons taking part in races that the part of the course in question is open to traffic generally, and therefore closed for races; and (b) that signs are displayed on any road giving access to the course, to indicate that vehicular traffic may cross or proceed along the course, as the case may be. (6) The Clerk of the Course must give public notice in such manner as he or she considers appropriate of the opening of crossing places and access corridors referred to in sub-paragraph (4) including broadcasts on radio stations in the Island. (7) A person must not drive any vehicle or cause or permit any vehicle to be driven on any part of the course which is the subject of any authorisation under paragraph (2) other than pursuant to that authority and in accordance with the directions of a constable or marshal. 9 Restrictions on speed on the course during closure period (1) Any motor vehicle, authorised by the organiser to travel on the course during a closure period, must not exceed a speed of 80mph. (2) Despite paragraph (1), any motor vehicle, authorised by the organiser to travel on the A18 Snaefell Mountain Road section of the course during a closure period must not exceed a speed of 100mph. (3) Paragraphs (1) and (2) do not apply to – (a) competing vehicles; (b) emergency service vehicles; and (c) travelling marshal vehicles whilst – (i) responding to an incident; or
(ii) moving between points on the course, whilst racing is taking place.

10 Footbridges (1) Nothing in article 5 prevents a pedestrian crossing the course by means of a footbridge (if any) erected for the purpose, unless forbidden to do so by a constable or marshal. (2) During a closure period no person may stop or loiter on any footbridge referred to in paragraph (1). 11 Prohibited areas (1) The Clerk of the Course must ensure that —
(a) the extent of a prohibited area is clearly marked and indicated by signs bearing the words “Prohibited Area”; and (b) so far as is reasonably practicable, no person contravenes paragraph (2). (2) During a closure period, a person must not enter or remain, or cause or permit any vehicle to enter or remain on a prohibited area, except to go to the aid of a person or to prevent further danger or risk to the competitors or any other person. 12 Restricted areas (1) The Clerk of the Course must ensure that —
(a) the extent of a restricted area is clearly marked and indicated by signs bearing the words “Restricted Area”; and (b) so far as is reasonably practicable, no person contravenes paragraph (2). (2) During a closure period, except in accordance with paragraph (3), a person must not enter or remain, or cause or permit any vehicle to enter or remain on a restricted area. (3) Paragraph (2) does not apply to— (a) race officials, marshals or police officers in the course of their duty; or (b) photographers, television crew or other persons or vehicles approved by the Clerk of the Course. 13 Hazardous areas (1) The organiser must place signs on or near to a hazardous area to indicate that it is the Department’s view that the use of the area by any person (including race officials) would constitute a hazard to their safety, or the safety of others.

(2) So far as is reasonably practicable, the organiser must give oral or written notice to draw the attention of persons using the land to the Department’s view that the use of the land constitutes a hazard. 14 Appointment of Marshals and other officials (1) The organiser must appoint marshals in respect of any race to be held pursuant to this Authorisation. (2) Subject to paragraph (3), the organiser must ensure that directions are given to the marshal to administer and enforce this Authorisation. (3) Any directions given to the marshal under paragraph (2) must clearly indicate that it does not include the enforcement of article 19. (4) The organiser must ensure that a suitable and sufficient number of marshals are appointed and present at appropriate locations around the course to enforce this Authorisation. 15 Parking on ambulance access routes Without the permission of a constable, a marshal or the organiser, a person must not cause or permit a vehicle to wait within 100 metres, or less as indicated by signage, on a side road specified in Schedule 5 during a closure period. 16 Cancellation and suspension etc. (1) If the Clerk of the Course, as the agent of the organiser, is given a change notice under section 8 of the Act, he or she must stop, cancel, suspend or postpone a race or any part of a race. (2) If a person exercises the power under paragraph (1), that person must notify the senior police officer and take such measures (if any) as he or she considers appropriate to inform the public of the effect of it.
17 Notification of end of a closure period (1) At the end of a closure period — (a) the Clerk of the Course; or (b) the senior police officer, after consulting the Clerk of the Course, must arrange for one or more motor vehicles, marked in accordance with paragraph (2), to travel the course. (2) As respects any part of the course, a closure period will be treated as completed for the purposes of this Authorisation when an official motor vehicle, displaying in a prominent position, a notice with the words “Roads Open”, has passed along that part of the course.

(3) Any official motor vehicle referred to in paragraphs (1) and (2) above, displaying the words “Roads Open” must not exceed a speed in accordance with article 9. 18 Erection of signage (1) The Clerk of the Course must ensure that signage (including barriers, diversion signs and closure signs) is erected and maintained on all side roads immediately before, or as soon as possible after, the beginning of every closure period, and in any event before the relevant part of the c
