Please provide a copy of the waste exemption application form that the Departments Environmental Protection Unit requested that Reayrt Vradda submit to the Department in an email to the company dated 25th August 2023.
While our aim is to provide information whenever possible, in this instance the public authority does not hold or cannot, after taking reasonable steps to do so, find the information that you have requested. This is because, although an application for a waste exemption for import of construction and demolition waste to Reayrt Vradda was asked for on 25 August 2023 from a Director of the company developing the site at that time, we have no record of receiving any written application.
If no form was submitted, please advise why the matter was not followed up.
There is no legal requirement for an application for such an exemption or for such an exemption to be authorised by the Department, however particularly in cases where there are complaints, the Environmental Protection Unit will ask for completion of a form to demonstrate deposit of such waste meets the exemption criteria and does not require a Waste Disposal Licence.
To offer advise and assistance, the relevant sections of the Collection and Disposal of Waste Regulations 2000, are:
Schedule 2 - Waste to be treated as industrial waste 5. Waste arising from works of construction or demolition, including waste arising from work preparatory thereto.
Schedule 5 - Activities for which a disposal licence is not required 4. (1) The deposit on land of wastes of the descriptions set out in paragraphs 5 and 6 of Schedule 2, or of ash, slag or clinker, provided that the deposit: (a) Is made for the purposes of construction currently being undertaken on the land on which the waste is deposited, and (b) Is made by, or with the consent of, the lawful occupier of the land.

Further to complaints about illegal deposit and processing of waste at this site several site inspections were carried out by Environmental Protection Officers who were satisfied the construction and demolition waste deposited was for the purposes of construction on site and a Waste Disposal Licence was not required. The site was identified as having planning approved under PA 20/00496/B and 21/01009/B for the development of a glamping pod/cabin tourist site and permitted considerable landscaping which it was understood this material was predominantly being used.
