We write further to your request, received 26 August 2025, which states:
"On the 26 June 2025 the secretariat to Planning Appeals received an Inspectors report to Appeal AP25/0003. Please provide all information/copy of notes/emails/ letters which were attached to any distribution to date of the above dated Report."
Our response to your request is as follows:
While our aim is to provide information whenever possible, in this instance we are
unable to provide some of the information you have requested because it is absolutely
exempt under section 25(2)(a) and (b)(i) & (ii) of the Act (absolutely exempt personal
information). The reasons why that exemption applies are that:
• The Cabinet Office is satisfied that the information amounts to personal data of
which you are not the data subject; and
• The Cabinet Office is satisfied that disclosure of the information would
contravene one of the data protection principles as set out at Article 5 of the
General Data Protection Regulation as it applies in the Isle of Man pursuant to
the Data Protection (Application of GDPR) Order 2018, namely that the Cabinet
Office can only disclose the information where it would be fair, lawful and
meet one of the conditions for lawful processing in Article 6 and in this case,
none of those conditions have been met
The only distribution of the report by the Secretariat to Planning Appeals was to the office of the Minister of the Department of Environment, Food and Agriculture. A copy of the email relating to that distribution of the report is included at Annex A.
By way of further advice and assistance, please note that any further distribution or publication of the Inspector’s report or any associated documentation would be undertaken by the Department of Environment, Food and Agriculture. As such you may wish to submit a Freedom of Information Request to that Department.
