We write further to the outcome of your internal review request, dated 03 October 2025, and your subsequent confirmation of how you would like to proceed in relation to the practical refusal reason. The final decision of the internal review was:
The final decision of this review is that it partly upholds your complaint, as some of the information you have asked to be disclosed can be released to you, depending on how you would like to proceed in relation to the practical refusal reason.
Our response to your request is as follows:
Please find attached the additional information which is being released to you following the outcome of your internal review request. The additional information is specific to part (e) of your request and details the Standard Occupational Classification (SOC) codes and the number of visas issued.
The information which is subject to disclosure contains personal information. In this instance we are unable to provide some of the information you have requested because it is absolutely exempt under 25 of the Act (absolutely exempt personal information).
The information to which this exemption applies to some of the SOC codes. The SOC code can be used to identify job roles and it is acknowledged that a job role on its own it not always a direct identifier, however when a job role is combined with other data it can identify an individual. Which increases the risk of the individuals being identified, as explained in the internal review response dated 03 October.
The reasons why this exemption applies are that:
• The Treasury is satisfied that the information amounts to personal data of which you are not the data subject; and
• The Treasury is satisfied that disclosure of the information would contravene
one of the data protection principles as set out at Article 5 of the General Data protection Regulation as it applies in the Isle of Man pursuant to the Data Protection (Application of GDPR) Order 2018, namely that the Treasury can only disclose the information where it would be fair, lawful and meet one of the conditions for lawful processing in Article 6 and in this case, none of those conditions have been met.
