I request information in relation to the following Castletown food businesses listed; The George Hotel, Kizuna, Time Out Noodle Bar and The Garrison. Namely: Dates of food hygiene and other premises inspection visits conducted at these premises since 1st January 2019; and Copies of all information relating to such inspections. This includes but is not limited to inspection reports, photographic images, enforcement notices and other guidance/advice provided subsequent to a visit, follow up communication between establishment and DEFA etc; and If the listed establishments were not registered as of 1 January 2019 or have in the period up until the date of this request ceased operation the dates of registration/deregistration as a food business.

Please review the report and address the required actions. I would particularly highlight the following as some were contained within your last inspection report (20/01/2024) and no progress has been made: Purchase a thermometer so you can ensure your hot hold temperatures are correct. If the lamp on the hot hold has not been replaced you should not be using this portion of the hot hold until it is replaced, as it cannot maintain temperature. You need to review your defrosting procedures – you must not defrost chicken at room temperature. Either arrange deliveries earlier to allow time for the chicken to defrost in the refrigerator, or consider ordering chilled instead of frozen. Ensure that the WC has soap at all times, as well as the hand wash sink in the kitchen. The pot wash sink must not be used for hand washing. You must get a food safety management system in place. Our response to your request is as follows:

Dates of food hygiene and other premises inspection visits conducted at these premises since 1st January 2019

The George Hotel was inspected on 23/01/2024.

While our aim is to provide information whenever possible, in this instance the public authority does not hold or cannot, after taking reasonable steps to do so, find some of the information that you have requested. This is because Kizuna and The Garrison have not been inspected since 1 January 2019.

Section 20 – Information accessible to applicant by other means While our aim is to provide information whenever possible, under section 20 of the Act, we are not required to provide information in response to a request if it is already reasonably accessible to you, whether free of charge or on payment of a fee.

s25(b)(i)&(ii) – Absolutely exempt personal information While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because it is absolutely exempt under section 25 of the Act (absolutely exempt personal information). The reasons why that exemption applies are that:

• The Department of Environment Food and Agriculture is satisfied that the information amounts to personal data of which you are not the data subject; and

• The Department of Environment Food and Agriculture is satisfied that disclosure of the information would contravene one of the data protection principles as set out at Article 5 of the General Data Protection Regulation as it applies in the Isle of Man pursuant to the Data Protection (Application of GDPR) Order 2018, namely that Department of Environment Food and Agriculture can only disclose the information where it would be fair, lawful and meet one of the conditions for lawful processing in Article 6 and in this case, none of those conditions have been met.
