We write further to your request received 10 April 2025, which states:
"Confirmation as to whether the DESC is actually adhering to the provisions of the relevant Acts with regard to independent University student grants, without hiding behind GDPR with respect to blocking contributories who are still funding students. Potentially a waste of taxpayers money."
On 14th April 2025 we sought clarification as to what information you are seeking in order to identify and locate the information.
On 14th April 2025 you responded:
“Why can you not respond generally regarding this. The DESC has already hidden behind specific issues.
For clarity, kindly explain whether the DESC Grants team do adhere to all of the requirements of section 4 of the 2019 Act, with regard to independent students rules. I’m aware of situations where they have most definitely not adhered to the Act.
This is a continuance of 19 months of trying to get clarity.”
Our response to your request is as follows:
While our aim is to provide information whenever possible, in this instance the Department of Education, Sport and Culture does not hold or cannot, after taking reasonable steps to do so, find the information you have requested. The reason for this is, an adequate description of the information you are seeking has not been provided to enable the Department to identify and locate information.
Further, please note that section 8 of the Freedom of Information (FOI) Act 2015 provides a right to ‘information held by a public authority’ it does not provide any right to lodge, nor require a public authority to respond to, questions, the provision of an
opinion on a policy or other matter, confirmation or rebuttal of a statement, or a ‘yes/no’ answer.
For the above reasons the Department of Education, Sport and Culture is not required
to comply with your request.
