While our aim is to provide information whenever possible, in this instance the Department of Health and Social Care (the Department) is unable to provide the information that you have requested. This is in line with Section 11(3)a of the Act, as a practical refusal reason applies; namely we do not hold or cannot, after taking reasonable steps to do so, find the information that you have requested.
While our aim is to provide information whenever possible, under Section 15 of the Freedom of Information Act 2015 (Duty to provide advice and assistance), the Isle of Man’s Group Practices (not including Ballasalla Group Practice) are private entities contracted by the Isle of Man Government through Manx Care to provide community based health services. As these entities are not under the direct control of Government, they are not classed as ‘Public Authorities’ and not subject to the Freedom of Information Act 2015.
Dependant on the reporting structure implemented, you may wish to re-apply your FOI request to Manx Care for any information provided to them as part of their contract with the relevant Group Practice you are enquiring about. This can be completed through the Isle of Man Government FOI portal.
