Dear ###
We write further to your request which was received on 30 April 2018 and which states:
"It states that the mountain road was closed on this date for 'TT preparation work' Why have Porsche, today 30/04/2018, uploaded a video of their new car on social media platform Instagram, utilising closed road around the Isle of Man including the mountain road? As far as i am aware, no signs or news stated it would be closed for filming purposes? https://www.energyfm.net/cms/news_story_525303.html" Clarification: Your request as it stands is a statement and not a request for information, you have clarified that you want proof that the DOI were up the Mountain during the recent closure 10-12th April and that could be any documentation proving that work was carried out i.e. job sheets, video, photographs etc
Our response to your request is as follows:
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because it is absolutely exempt under section 25 of the Act (absolutely exempt personal information). The reasons why that exemption applies are that • The Department of Infrastructure is satisfied that disclosure of the information would contravene one of the data protection principles, namely that the Department of Infrastructure can only disclose the information where it would be fair, lawful and meet one of the conditions in schedule 2 and in this case, none of those conditions have been met.
Appendix 1 – Timesheets
Appendix 2 – Programme of works Appendix 3 – List of Inspections recorded Appendix 4 – Minutes of Meeting recording Actions to be carried out during closure Appendix 5 – Copy of the Closure Other actions carried out on the Mountain and evident as your travel over it, but for which we do not have actual held information on, are the installation of the one-way signage (which is missing from Porsche video footage), marshals huts, bridges painted and patching.
As far as we have been able to ascertain Porsche were not on the Mountain, and were not given permission to go on the Mountain during our closure.
Please quote the reference number 451540 in any future communications.
