As it is currently worded your request is too broad and the effort required to meet the request is so disproportionate in terms of the strain on time and resources, that the Department cannot reasonably be expected to comply. There is a planning history of 9 applications (listed below) and 4 enforcement investigations on the site in question. 94/00389/B 08/00981/R 08/02140/R 97/01100/B 94/01481/B 95/00446/A 97/01099/A 93/01490/B 94/00388/B In relation to the Planning Applications there is already a lot of information in the public domain which is available via the online search facility available here https://services.gov.im/planning-applications/ or by visiting the Planning Office at Mount Havelock, Douglas. As part of your reply could you also please confirm the plan below, outlined in red, is the "Site G" to which you refer? 4 In addition to the number of applications and investigations relating to this site the burden of searching and considering the entirety of the document list you mention would also be disproportionate to the likely benefit and would interfere with the day-to-day operations of the Department. Our aim is to provide information wherever possible, and we request that you be more specific about the information you are requesting. The parameters of the request need to be narrowed in order that the burden of work can be managed more effectively. If you are not able to narrow your request, then we will consider whether the request amounts to being 'vexatious, malicious, misconceived or lacking in substance', pursuant to section 11(3)(d) of the Act. The purpose of this provision is to protect the resources of a public authority in its everyday business from disproportionate use of the Act. We are only able to exercise this after providing advice and assistance to you, which is the purpose of this email. Whether a request is vexatious, malicious, frivolous, misconceived or lacking in substance depends on the circumstances of each case and relates to the request not the requester. We will not be able to process your request until this information is received and you have 28 days from the date of this notice (22nd May 2018) in which to respond. Should you respond after this time the Department can refuse to provide you with the information requested.
