Registration & Inspections
While our aim is to provide information whenever possible, in this instance the Department must apply a ‘Practical Refusal Reason’ to this part of your request under Section 11(3)b of the Act. Under Section 8(3)c, the Department are not required to undertake substantial compilation or collation of information. The Department have applied this exemption as it would require a substantial amount of staffing and hours to review individual case records to compile the information requested.
Mandate
In relation to a request from the Department for clarification on this question you
mentioned the role that the Department has in relation to the DHSC monitoring and
assuring Manx Care's performance and advised that you “would like information on
how many times DHSC has taken regulatory action in relation to Manx Care or any other service DHSC regulates”.
For advice and assistance, the mandate team strategically commissions health and social care services from Manx Care via the mandate. The Department then monitors and assures Manx Care's performance in the delivery of services under the mandate. This is not a regulatory function but a performance function. Under section 30 of the Manx Care Act 2021, if the Department considers that Manx Care is failing to discharge its functions or comply with regulations and that failure is significant it may take steps to rectify the failure and to prevent its repetition. The Department has not issued any directions under this section of the Act.
