We write further to your request, received 15 January 2025, which states:

Our response to your request is as follows: I have detailed below the information.

A copy and the expiry date of the contract between the Department of Infrastructure and Caterleisure is qualified exempt information under FOIA Section 30 (2)(b), as it’s disclosure would be likely to prejudice the commercial interests of the Department. As section 30 is a qualified exemption, it is subject to a public interest test. The public interest must be something that is of serious concern and benefit to the public at large.

Factors in favour of disclosure • Transparency in the spending of public funds

Factors in favour of withholding • Need to protect the commercial interests of the Public Sector to ensure value in spending of public funds
• Public interest in maintaining a competitive market for future procurement exercises
• The need to protect the commercial interests of the private sector

In taking these factors into account the Department of Infrastructure determined that the factors in favour of maintaining the exemption outweigh the factors in favour of disclosing the information.

In addition, the Department does not hold tender documents or the evaluation criteria for the next airport catering contract as they have not yet been created.

I have provided an overview of the tender process for you below:

As part of the preparation for the next phase, the contract is expected to go out for Expressions of Interest (EOI) and tender via the Government portal.

The tender process will be conducted in line with Government procurement regulations and placed on the government tender portal: https://intendhost.co.uk/iomg/aspx/Home

Detailed criteria, requirements, and expectations for bidders will be outlined comprehensively within the tender documents which will be available on the portal site once the contract goes out for tender.
