Our response to your request is as follows:

In providing this response, the Department is cognisant that a recent question required the publication of the top 20 salaries for each Department, the figures provided in that response included basic salary, overtime, and other applicable allowances etc., the information held by the Department and provided is for the current year and only includes basic salary payments, this may lead to a discrepancy between the information provided and the response to the written question for the current period.

While our aim is to provide information whenever possible, in this instance the Department for Enterprise is unable to provide some of the information you have requested because it is absolutely exempt under section 25(2)(b) of the Act (absolutely exempt personal information).

The reasons why that exemption applies are that:

• The Department is satisfied that the information amounts to personal data of which you are not the data subject; and • The Department is satisfied that disclosure of the information would contravene one of the data protection principles as set out at Article 5 of the General Data Protection 3 | P a g e
Regulation as it applies in the Isle of Man pursuant to the Data Protection (Application of GDPR) Order 2018. Namely that the
Department can only disclose the information where it would be fair, lawful and meet one of the conditions for lawful processing in Article 6 and in this case, the Department considers that none of those conditions have been met.

The Department directly employs a number of individually contracted persons who do not fall under the responsibility of the Public Service Commission and as a consequence do not have a specific pay scale. These positions have no maxima as they are individually negotiated. To disclose the maxima, which in effect will be the actual amount being paid to the staff member concerned, may lead to the identification of that person and would therefore likely be a breach of their rights as stated above. However, these individual posts have been included in answer to your request in part one and three of your request as they cannot be easily identified in terms of salary paid.
