I request information in relation to the following Castletown food businesses listed viz: Coffee Craft (Manannan House, Market Square), The Cupcakery (26 Arbory Street), Kowloon House (3 Arbory Street), Victoria Grill (13 Malew Street) and The Vintage Tea Rooms (9 Malew Street) namely: Dates of food hygiene and other premises inspection visits conducted at these premises since 1st January 2019; and Copies of all information relating to such inspections. This includes but is not limited to inspection reports, enforcement notices and other guidance/advice provided subsequent to a visit, follow up communication between establishment and DEFA etc; and If the listed establishments were not registered as of 1 January 2019 or have in the period up until the date of this request ceased operation the dates of registration/deregistration as a food business.

I request information in relation to the following Castletown food businesses listed viz: Coffee Craft (Manannan House, Market Square), The Cupcakery (26 Arbory Street), Kowloon House (3 Arbory Street), Victoria Grill (13 Malew Street) and The Vintage Tea Rooms (9 Malew Street) namely:

Copies of all information relating to such inspections. This includes but is not limited to inspection reports, enforcement notices and other guidance/advice provided subsequent to a visit, follow up communication between establishment and DEFA etc; and
If the listed establishments were not registered as of 1 January 2019 or have in the period up until the date of this request ceased operation the dates of registration/deregistration as a food business.

The Cupcakery and Victoria Grill: while our aim is to provide information whenever possible, in this instance the public authority does not hold or cannot, after taking reasonable steps to do so, find the information that you have requested. This is because the Department has not conducted food hygiene inspections on The Cupcakery or Victoria Grill.
- Copies of all information relating to such inspections. This includes but is not limited to inspection reports, enforcement notices and other guidance/advice provided subsequent to a visit, follow up communication between establishment and DEFA etc.
I have enclosed copies of the information being released to you.
Section 25(b)(i)&(ii) – Absolutely exempt personal information While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because it is absolutely exempt under section 25 of the Act (absolutely exempt personal information). The reasons why that exemption applies are that: • The Department of Environment Food and Agriculture is satisfied that the information amounts to personal data of which you are not the data subject; and • The Department of Environment Food and Agriculture is satisfied that disclosure of the information would contravene one of the data protection principles as set out at Article 5 of the General Data Protection Regulation as it applies in the Isle of Man pursuant to the Data Protection (Application of GDPR) Order 2018, namely that the Department of Environment Food and Agriculture can only disclose the information where it would be fair, lawful and meet one of the conditions for lawful processing in Article and in this case, none of those conditions have been met.
- If the listed establishments were not registered as of 1 January 2019 or have in the period up until the date of this request ceased operation the dates of registration/deregistration as a food business.

Kowloon House: while our aim is to provide information whenever possible, in this instance the public authority does not hold or cannot, after taking reasonable steps to do so, find the information that you have requested. This is because the Department does not hold information regarding the registration of Kowloon House. To offer advice and assistance the file for Kowloon House was opened by the Environmental Health team on 10.01.2011 and registration details were updated on 18.03.2023. The file was closed on 15.08.2024 and they are no longer registered on the food business register.
Victoria Grill: while our aim is to provide information whenever possible, in this instance the public authority does not hold or cannot, after taking reasonable steps to do so, find the information that you have requested. This is because the Department does not hold information regarding the registration or deregistration of the Victoria Grill.
