Our response to your request is as follows: I have detailed below the information.
Q1.
The organisational structure of all staff paid by the Authority either
directly or indirectly
A1. The organisational chart available on the Isle of Man Financial Services Authority’s (‘the Authority’) website identifies the Members, CEO and other key staff. Here is a link to that chart: authority-org-chart.pdf (iomfsa.im).
Attached as Appendix A to this letter is a further organisational chart that details the job grades across the Authority, this displays the current headcount of filled posts.
Q2. The Job titles of all individual staff employed within such organisational structure
A2. The Authority has released to you within Appendix A the job grades across the Authority’s structure, with key staff members’ job titles. Other staff members’ job titles are not being released as they fall under the Freedom of Information Act 2015, Section 25 Absolutely exempt personal data.
Q3. The names of all post holders attached to such Job Titles
A3. In the Authority’s organisational chart available to the public on the Authority’s website, and within Appendix A to this letter the Authority has provided to you the names of the Authority’s Members, CEO and key staff. The remaining staff members’ names are not being released as they fall under the Freedom of Information Act 2015, Section 25 Absolutely exempt personal data.
Q4. The Salary maxima of all persons attached to such Job Titles
A4. The organisational chart provided to you within Appendix A to this letter shows the job grades across the Authority’s organisation.

A5. The Authority’s Board Members are appointed by Treasury (and approved by Tynwald). Members’ names are provided on the organisational chart available on the Authority’s website: authority-org-chart.pdf (iomfsa.im).

The Authority has no agency or contract staff. Whilst some contractors are paid for their work on Authority projects, this is payment for work undertaken and does not constitute staff being paid by the Authority.

A6. Authority Members are appointed by Treasury (and approved by Tynwald). Members are employed by the Isle of Man Government and are paid directly via Government payroll. The cost of Members’ fees and expenses is met by the Authority.
The Authority does not employ any staff through employment agencies, employment businesses or through limited liability companies.

The salary maximum of the Authority CEO is exempt as it falls under the Freedom of
Information Act 2015, Section 25 Absolutely exempt personal data.

The Authority’s Annual Report 2023/24 will include the salary breakdown for 2023/24,
which will be published on the Authority’s website in late 2024.
s25(b)(i)&(ii)
While our aim is to provide information whenever possible, in this instance we are
unable to provide some of the information you have requested because it is absolutely
exempt under section 25 of the Act (absolutely exempt personal information). The
reasons why that exemption applies are that:
• The Isle of Man Financial Services Authority is satisfied that the information
amounts to personal data of which you are not the data subject; and
• The Isle of Man Financial Services Authority is satisfied that disclosure of the
information would contravene one of the data protection principles as set out
at Article 5 of the General Data Protection Regulation as it applies in the Isle of
Man pursuant to the Data Protection (Application of GDPR) Order 2018, namely
that the Isle of Man Financial Services Authority can only disclose the
information where it would be fair, lawful and meet one of the conditions for
lawful processing in Article 6 and in this case, none of those conditions have
been met.
