We were promised there was allowances in place for remedial work on the promenade but that didn't prevent substandard work from being completed here which is already breaking up.

We write further to your request, received 30 July 2024, which states:

"What assurances are in the contract for the new sea wall to ensure quality? Whilst I appreciate it is not complete, parts of the wall are already crumbling and it appears the material is substandard.

We were promised there was allowances in place for remedial work on the promenade but that didn't prevent substandard work from being completed here which is already breaking up."

Our response to your request is as follows: I have detailed below the information that is being released to you.

The construction of the new sea wall along the Douglas Promenade walkway is being managed under an NEC4 Engineering and Construction Contract – Option B.

Under this contract, the Department of Infrastructure has provided a detailed Scope and Specification for the wall construction. The Contractor must deliver the construction accordingly. As part of these requirements, the Contractor provided two test panels in advance of the work, to demonstrate adherence to the quality required.

Should the Contractor fail to provide the required construction quality, the Contract permits the Department to notify any deviation as a Defect, which the Contractor has to remedy at the Contractors cost.
