While our aim is to provide information whenever possible, in this instance the Cabinet
Office does not hold the information that you have requested.
The Freedom of Information Act 2015 (the Act) entitles Isle of Man residents to information held by a public authority. The definition of held is set out at section 8(2) of the Act which stats that information is held by a public authority if it is held
“a) by the public authority, otherwise than on behalf of another person b) by another person for or on behalf of the public authority.”
The Public Services Commission is a separate public authority to the Cabinet Office for the purposes of freedom of information. Any communication held by the Cabinet Office in the scope of the request is held by the Cabinet Office on behalf of another person, namely the Public Services Commission.
The Public Services Commission Act 2015 requires the Chief Minister to appoint a chairperson and vice-person to the Public Services Commission who must be members of Tynwald. The appointment of Hon Kate Lord-Brennan MHK as chairperson of the Commission is distinct and separate to her role as Minister for the Cabinet Office.
