While our aim is to provide information whenever possible, in this instance the information is exempt from disclosure under section 30 of the Act as disclosure would be likely to prejudice the commercial interests of a person including the public authority holding it.

Specific Issues you raised In your Internal Review you said –
We are not looking to identify the film booker used by Broadway Cinema, simply the sums paid to them.
This information would not prejudice the Villa Gaiety's working relationship with their booker, neither would it provide an 'unfair, detrimental or a competitive advantage in a commercial market.' There is no coherent reason not to provide this information in a timely manner.
We would also like to understand the process of retaining a booker for the Broadway Cinema - was it open to public tender and if it wasn't, what exemptions have been utilised? This will allow us to understand if public money is being used effectively and in a fair manner when competing against private operators.

In regards to your additional query there wasn’t a public tender exercise undertaken as the sums concerned are below thresholds for such to be undertaken. For information an exemption has been granted.

Our response to your request is as follows:
While our aim is to provide information whenever possible, in this instance the information is exempt from disclosure under section 30 of the Act as disclosure would be likely to prejudice the commercial interests of a person including the public authority holding it.
As section 30 is a qualified exemption, it is subject to a public interest test. The public interest must be something that is of serious concern and benefit to the public at large.
Factors in favour of disclosure • Accountability - Need to ensure that commercial activities are conducted in an open and honest way • Transparency - Release of some information promotes public understanding and informed debate. • Accountability for the spending of public funds. Ensuring that public money is being used effectively and Departments are getting value for money when purchasing goods and services.
Factors in favour of withholding • It is not in the public interest for the Villa Gaiety’s working relationships with their bookers to be prejudiced by the disclosure of the requested information. • Disclosure of this information could be used to achieve, unfair, detrimental or a competitive advantage in a commercial market.
• There is a need to protect the commercial interests of the private sector, which plays an important role in the general health of the economy.
In taking these factors into account the the Department of Education, Sport and Culture determined that the factors in favour of maintaining the exemption outweigh the factors in favour of disclosing the information.
