Dear

REQUEST UNDER THE FREEDOM OF INFORMATION ACT 2015 (“the Act”) Thank you for your request to the Department of Health and Social Care, dated 16th January 2018. Your request You asked for: Question 01: “How many Acting Executive Officers are there currently across the DOHSC and hospital? ie, Admin Officer and Personal Secretary Grades 'acting up' temporarily in EO management/supervisorial roles? where these vacancies can't be filled or EO's have left or stepped down.” Question 02: “How many employees are subject to/on capability procedures/how many have been carried out across DOHSC on employees from 2010 to current time?” Response to your request While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested; the reasons are shown as part of the corresponding answers below. Question 01: How many Acting Executive Officers are there currently across the DOHSC and hospital? ie, Admin Officer and Personal Secretary Grades 'acting up' temporarily in EO management/supervisorial roles? where these vacancies can't be filled or EO's have left or stepped down While our aim is to provide information whenever possible, in this instance Department of Health and Social Care (“the Department”) is unable to provide the information you have requested in Question 01. This is in line with section 11(3)a of the Act, as a practical refusal reason applies; namely we do not hold or cannot, after taking reasonable steps to do so, find the information that you have requested. This is because the Office of Human Resources database record does not distinguish the reason for appointments so an acting appointment cannot be differentiated from any other appointment.

Page 2 of 2 FOIA/DHSC/rvsd/01 Question 02: How many employees are subject to/on capability procedures/how many have been carried out across DOHSC on employees from 2010 to current time?” Please find the Department’s response to Question 02: While our aim is to provide information whenever possible, in this instance Department of Health and Social Care (“the Department”) is unable to provide the information you have requested in Question 01. This is in line with section 11(3) a of the Act, as a practical refusal reason applies; namely we do not hold or cannot, after taking reasonable steps to do so, find the information that you have requested. This is because the Office of Human Resources does not hold information relating to cases concluded prior to April 2014 and does not hold complete information for subsequent years as many cases will be progressed independently by line management.

However, we are able to provide the number of cases relating to capability procedures recorded on the Office of Human Resources database since 2014 which is 387. This includes cases that may have been opened in earlier years but were still on-going when the database was set up.
