As part of our routine post-response checks, an omission has been identified in the information we provided you with and we would like to take the opportunity to correct that.

Part 1 of our response included information in relation to disposals of land and property by the Isle of Man Government up until 31 March 2017: it did not include information about disposals that took place between 1 April 2017 and 4 December 2017 (that being the date of your request). It is our view that this information could have been provided to you as part of our initial response.

Accordingly, the table overleaf provides information relating to disposals of land and property by the Isle of Man Government that took place in the period 1 April 2017 to 4 December 2017.

Please provide details of the properties disposed off by IOM government since the Council of Ministers Sub Committee Report ‘Management of Government Owned Properties’ 2009, Please break this down by Department, and by what method was it disposed off, ie transfer to other dept, public tender, closed bids, private sale etc, the date and the sum achieved. Please advise where the current list of properties owned by government may be found if available? Please advise any that are currently awaiting completion.

In respect of that portion of the information requested, created on or after 11 October 2011, I am pleased to enclose at Annex A the information you have requested. Further to our correspondence, it may be useful to provide some context in relation to the information provided:

The procedure to be followed in respect of disposal of land and property are as required by the Isle of Man Government Financial Regulations, specifically, Financial Direction 29. The Regulations can be found as follows: - https://www.gov.im/media/1354966/isle-of-man-government-financial-regulations- august-2017.pdf

The Council of Ministers’ Policy on the Disposal of Government Land (the Policy) states that property should be publicly advertised and be subject to open sale, tender or auction.

However the Policy does allow for exceptional circumstances which must be first approved by the Board or Minister of the relevant Government body, and then approved by the Treasury prior to negotiations reaching an advanced stage. The Policy also stipulates that Treasury approval is required to dispose of properties between Government bodies and for disposals which are sales to Local Authorities.

The Policy requires Departments etc. to confirm that other Government bodies have no interest in acquiring the land to be sold and Government’s Financial Regulations require that this confirmation should be provided to the Strategic Asset Management Unit (SAMU) which has a central role in co-ordinating property disposals across Government. Over the time period covered, SAMU originally sat with the Department of Infrastructure, then transferred to the Treasury but now the Asset Management Unit sits back with the Department of Infrastructure. Treasury therefore does not hold these records.

The Policy requires a Treasury Officer, the Government Valuer, to provide valuations in respect of sales but Treasury does not necessarily receive or hold information on the final disposal, for example, the date of disposal.

For the purposes of the central Government accounts, Treasury holds a register of fixed assets, relying on Departments to advise of any disposals of assets including land and properties. However, that information does not include the method of disposal.

Sales of properties under the provisions of the House Purchase Assistance Scheme 2007 (HPAS) are exempt from the Policy. Taking the above factors into consideration, we have compiled a list of Government land and property disposals using data held within the central Government accounts along with data held by SAMU. This information is provided at Annex A.
As the Government Accounts for 2017/18 are not yet completed, the information is up to the end of March 2017. The information excludes external disposals by the Manx Utilities Authority and the Isle of Man Post Office as Treasury does not hold detailed financial records for those entities.
2. Where is a current list of properties owned by Government available?

The Government does not publish a list of the properties it owns.
