INFORMATION REQUESTED For each of the Island's primary schools, please provide the percentage of pupils completing KS2 in the academic year 2016/17 who attained;

a) Level 2 b) Level 3 c) Level 4 d) Level 5 e) Level 6 f) Level 7

in each of the following: i) Speaking and Listening ii) Reading iii) Writing iv) Mathematics v) Science

Department Response:-

While our aim is to provide information whenever possible, in this instance your request for key stage 2 information for primary schools for the 2016/17 academic year is being refused under a qualified exemption under Section 41 of the Act, as it is intended to publish this information at a future date.

The information is not yet ready to be published as the data is still subject to review and moderation.

Public Interest Test Sections 41 of the Act is a qualified exemption and is therefore subject to a public interest test. The public interest must be something that is of serious concern and benefit to the public at large.

Factors in favour of disclosing the information include: • promoting awareness of schools’ key stage 2 attainment levels; • scrutinising Government’s actions and use of resources; • holding Government appropriately to account.

Factors in favour of maintaining the exemption include: • that the information is still subject to review and moderation; • that the information may change as a result of the review and moderation exercise; • that early release of the information without review and moderation would be premature and potentially misleading; • that the information requested is proposed for future publication (via uploads to each primary school’s website) before the end of the Autumn term;

The underlying purposes of the exemption in section 41 is that:-  there is no entitlement to information if it is held with a view to being published at some future date (whether determined or not); and
 if it is reasonable in all the circumstances that the information be withheld from disclosure until that future date.

In assessing the weight to be attributed to each of the above factors we have taken the view that disclosure of information which has not yet been fully reviewed (and, where appropriate, moderated) would not be in the public interest at the current time as it may be subject to change. In its current state the information may not therefore present an accurate picture of key stage 2 attainment levels and may be misleading. Applying the section 41 refusal exemption is therefore considered to be reasonable, especially in view of plans to publish the information in the future.
