Can you please advise if Andrew Smith, MHK, declared a conflict of interest in the gas price increase vote in Tynwald in October 2021 due to his private business providing heating oil and firewood? If Mr Smith declared a conflict of interest, who granted permission for him to vote to support the gas price increase. If Mr Smith did not declare a conflict of interest, have any steps been taken to investigate an undeclared conflict?

I write further to your request which was received on 23 August 2022 and which states:

"Can you please advise if Andrew Smith, MHK, declared a conflict of interest in the gas price increase vote in Tynwald in October 2021 due to his private business providing heating oil and firewood? If Mr Smith declared a conflict of interest, who granted permission for him to vote to support the gas price increase. If Mr Smith did not declare a conflict of interest, have any steps been taken to investigate an undeclared conflict?" Our response In respect of paragraphs one and two of your request, while our aim is to provide information whenever possible, in this instance an Absolute Exemption applies under section 20(2)(b) of the Freedom of Information Act 2015 (Information accessible to applicant by other means). The Hansard of the debate Tynwald Court 19th October 2021, Item 10: Gas Regulation Act 1995 – Gas (Tariff Fixing) (Amendment) Regulations 2021 is available on the Tynwald website: https://www.tynwald.org.im/business/hansard/20002020/t211019.pdf With regard to paragraph three of your request: The remit of the Tynwald Standards and Members Interests Committee is set out in the Schedule to the Standing Orders of Tynwald Court at paragraphs 4.1 and 4.8. The Committee may investigate a specific matter relating to a Member’s adherence to the rules of conduct under the Code of Conduct for Members, including the expectation that Members observe the Standing Orders. We are not required to either confirm or deny whether we hold the requested information because, if the information requested did exist or if it was held by us, an exemption under s22(1)(a)(i) (Parliamentary privilege and business) of the Act would apply to that information. This is because disclosure of this information could reasonably be viewed as interfering with Tynwald’s right to oversee its own proceedings, including conducting an investigation into a Member’s conduct. Please find enclosed a copy of the certificate signed by the President of Tynwald certifying that the exemption is required. Please quote the reference number 2598157 in any future communications.
