1. An organisation chart, aka a "family tree", showing the distribution of the Department's functions into Divisions or Teams or whatever other descriptions the Department has chosen. 2. The full names of all Civil Service staff members occupying posts within such Divisions etc. 3. The Job titles of each member of such staff. 4. The Civil Service grading of each member of such staff. 5. The salary maxima of each member of such staff. 6. If any , the names and job titles of all non-Civil Service staff and whether - (a) they are directly employed by the Department and if they are they are the amount of salary or remuneration paid to them; and (c) they are employed via limited liability companies, or employment agencies or employment businesses, and if they are the names of their employer, and the amount of remuneration paid to them; and (e) they are self-employed and if so the amount of remuneration paid to them.

I write further to your request which was received on 26th May 2022, which asks for the following information:-

Our response to your request is as follows:
This Department publishes, on its website an organisation chart, identifying this
Department’s structure, however, this requires updating due to some changes within this
Department and a temporary organisation chart has been provided as part of this response,
see Annex A.
This Department has published the names of various team members on our website,
including in certain cases the job titles of many of its employees, this information may be
found on our main website, in the organisation chart and on the following web pages. It
should also be noted that consent has been given by the individuals for their names to
appear on these lists:

Where names do not appear consent has not been given by the individuals for their details
to be displayed on these websites or organisation charts and therefore the release of this
information does not contravene the data protection principles.
The information requested may form personal data under Article 4 of the applied GDPR and
for those names not already published elsewhere and other information requested, release
of that information may only occur if that release would not contravene the data protection
principles contained in Article 5, would not contravene an objection to processing or where
the information is exempt from the right of subject access.
In order to release the data, this Department must consider as to whether the disclosure will
comply with the general principles. In this case, the principle most relevant will be (a) which
states that personal data and any subsequent disclosure must be lawful, fair and in a
transparent manner in relation to the data subject (‘lawfulness, fairness and transparency’).
Article 6(1) of the applied GDPR contains the lawful bass for disclosure of personal
information. However, only (a) consent or (f) legitimate interests are relevant for disclosure
under the Act.
Article 6(a) Consent - This Department is not obliged to seek consent of its employees for
the disclosure of personal information, other than that already obtained in the normal course
of its operation.
Article 6(f) Legitimate Interests – as this Department is already publishing personal
information where consent has already been given, this Department must assess whether
there is a legitimate interest in the disclosure of information that has not been published
elsewhere.

In order for this Department to disclose the information it must assess whether this lawful
basis may be engaged, it must consider the purpose of the request, i.e. what is the
legitimate interest in the disclosure of the requested information, whether the disclosure is
necessary for that purpose and does the legitimate interest outweigh the interests and rights
of the individual?
As no indication has been provided as to a legitimate interest by the requestor, this
Department has considered the request from this perspective and it is of the view that the
only legitimate interest the requestor would have in this case is that of transparency.
A disclosure of information under the Act is deemed to be a disclosure to the world rather
than a disclosure to an individual requestor. Furthermore, requests for information should be
treated on an applicant blind basis. This Department therefore has considered the legitimate
interest aspect and has applied a balancing test to determine whether this outweighs the
rights of the individual.
This Department has reviewed the potential harm or distress that might be caused from the
disclosure and the reasonable expectations of its staff members, it has also taken into
consideration previous disclosures by other public bodies.
The Island is a small jurisdiction, disclosure of the requested information may, at certain
levels cause distress, in particular the disclosure of the salary information of individuals,
particularly those in non-public facing or at junior levels. It is entirely reasonable to expect
that more information would be disclosed abut senior Departmental employees than more
junior ones as senior employees should expect their roles to carry a greater level of
accountability. The same would be applied to those public facing roles, representing this
Department to the public in general.
This Department has also reviewed the current practice of responding to requests of this
type, in general the data has been disclosed in an anonymised fashion.
This Department therefore is content that the provision of the following information, in this
format will not breach the general data protection principles and disclosure in this manner is
both lawful, fair and transparent.
