Given the recent public announcement that the 'Government', which includes the Cabinet Office, and the Treasury were, 'in the interests of transparency' going to release the names of applicants or Covid grant payments, together with their addresses and the amounts paid to them by way of Covid grants, 'in the interests of transparency' please let me know the names of all persons employed in the Cabinet Office, together with their individual job titles and the salary maxima attaching to each person's post. I would be happy for you to remove - 1. C asual staff: no salary maxima can be produced for these roles as they are paid based upon hours performed. Please confirm whether casual staff are to be excluded from your request or what information you seek. 2. Part-time staff : data can be produced based on the pro-rata maxima or the full-time equivalent maxima. Please indicate what information you require. 3. Individual contracts : please note that individual contracts, by definition, do not have a salary maxima.

• All Job Titles in Cabinet Office • Each Cabinet Office Grade and FTE While our aim is to provide information whenever possible, in this instance Cabinet Office are unable to provide some of the information you have requested because it is absolutely exempt under section 25(b)(i)&(ii) of the Freedom of Information Act 2015 (absolutely exempt personal information). The reasons why that exemption applies are that: • The Cabinet Office is satisfied that the information amounts to personal data of which you are not the data subject; and • The Cabinet Office is satisfied that disclosure of the information would contravene one of the data protection principles as set out at Article 5 of the General Data Protection Regulation as it applies in the Isle of Man pursuant to the Data Protection (Application of GDPR) Order 2018, namely that the Cabinet Office can only disclose the information where it would be fair, lawful and meet one of the conditions for lawful processing in Article 6 and in this case, none of those conditions have been met. Article 6 (“A6”) (1) of the applied GDPR addresses the lawful basis for disclosure of personal information, set out in paragraphs (a) consent and (f) legitimate interests. The Cabinet Office has assessed whether this lawful basis may be engaged. In respect of A6(1) (a), the Department is not obliged to seek consent of its employees for the disclosure of personal information, beyond that obtained in the normal course of tis normal operation. In respect of A6(1) (f), the Department must assess whether there is a legitimate interest in disclosing information which has not been published elsewhere. Therefore consideration has been given to a legitimate interest in disclosure; whether disclosure is necessary for that purpose; and whether such legitimate interest outweighs the interests and rights of the individual. While a legitimate interest in access to this data has not been provided by the requestor, Cabinet Office considers that transparency may provide a legitimate interest. The Department has reviewed this interest in light of the rights of individuals, the potential harm or distress which may be caused by disclosure and the reasonable expectations of staff members. It has also taken into consideration previous disclosures by other public bodies. The following conclusions have been reached:
• Cabinet Office is satisfied that in respect of junior officers below HEO grade, release of information would contravene the data protection principle as set out at Article 5 of the applied GDPR. These officers’ expectation to privacy would be disregarded if their names were released to the world at large through a Freedom of Information request; • Cabinet Office considers that it is a reasonable expectation for more information to be released about staff in senior and public-facing roles (than those in more junior roles), to reflect the level of responsibility and accountability invested in senior staff.

Consequently, Cabinet Office is content to provide the following information in a manner which is lawful, fair and transparent and does not breach data protection principles.
