In the Decision referred to the Information Commissioner states in paragraph 34 "This suggests that the public authority is failing to consider each FOI Request for information (whether similar or not) on its own merits and instead automatically and routinely seeks to withhold information. This not only conflicts with the purpose of FOIA (section 3) but, in doing so, the public authority contravenes its statutory obligation under section 11" In respect of how many other requests for information made to the DfE has the DfE failed to consider each request on its own merits and instead has automatically and routinely sought to withhold information?

We write further to your request which was received on 24 January 2022 and which states:

"In the Decision referred to the Information Commissioner states in paragraph 34 "This suggests that the public authority is failing to consider each FOI Request for information (whether similar or not) on its own merits and instead automatically and routinely seeks to withhold information. This not only conflicts with the purpose of FOIA (section 3) but, in doing so, the public authority contravenes its statutory obligation under section 11" In respect of how many other requests for information made to the DfE has the DfE failed to consider each request on its own merits and instead has automatically and routinely sought to withhold information?"

While our aim is to provide information whenever possible, in this instance the public authority does not hold or cannot, after taking reasonable steps to do so, find the information that you have requested. The Department wrote to the ICO on 07 February 2022 to confirm that at no time was a blasé approach applied to the processing of Freedom of Information requests and that all requests are processed on their own merits. For noting, the Department has only had one request for ICO review within the last three years.
