Dear ###

We write further to your request which was received on 6 December 2021 and which states:

"In respect of Mrs Karen Malone, Director of Governance and Legislation and Deputy Chief Executive Officer Department of Health and Social Care, Isle of Man Government Please provide information as to her: 1. Higher Educational qualifications (i.e. what degrees does she have) 2. Professional qualifications e.g. solicitor, advocate or chartered accountant etc. 3. Salary 4. Please find our response to your questions below. 1. Higher Educational qualifications (i.e. what degrees does she have)

  1. Professional qualifications e.g. solicitor, advocate or chartered accountant etc.
  2. Salary
  3. Date of appointment
  4. Previous positions held in healthcare organisation(s) While our aim is to provide information whenever possible, in this instance we are unable to provide the information you have requested because it is absolutely exempt under section 25 of the Act (absolutely exempt personal information). The reasons why that exemption applies are that: • The Department of Health and Social Care (“the Department”) is satisfied that the information amounts to personal data of which you are not the data subject; and • The Department is satisfied that disclosure of the information would contravene one of the data protection principles as set out at Article 5 of the General Data Protection Regulation as it applies in the Isle of Man pursuant to the Data Protection (Application of GDPR) Order 2018, namely that the Department can only disclose the information where it would be fair, lawful and meet one of the conditions for lawful processing in Article 6 and in this case, none of those conditions have been met.
  5. Date of advertisement of her post
  6. Who was on the appointment panel
  7. How many other applicants applied for this post
  8. How many applicants were shortlisted
  9. What were the essential criteria for appointment to this post
  10. Job description, and date that job description was drafted While our aim is to provide information whenever possible, in this instance the Department of Health and Social Care ('the Department') is unable to provide some of the information that you have requested. This is in line with Section 11(3)a of the Act, as a practical refusal reason applies; namely we do not hold or cannot, after taking reasonable steps to do so, find the information that you have requested as it may be held by the Office of the Chief Secretary who made the appointment. You may wish to re-submit your request to the Cabinet Office, of which the Office of the Chief Secretary forms part of, which is an option available on the Freedom of Information request portal, who may be able to help you. To provide advice and assistance, I can confirm that if the requested information was held by the Department, it would be absolutely exempt under section 25 of the Act (absolutely exempt personal information) for the reasons set out above.
