Year being 2020/2021 Our clarification request In order to identify and locate the information that you have asked for we needed to clarify which division of the Department of Education, Sport and Culture the information requested is for. You advised The Minister in education and culture please. Response

Our response to your request is as follows: Meetings during the three lockdowns I have enclosed copies of the information.

While our aim is to provide information whenever possible, under section 20 of the Act, we are not required to provide information in response to a request if it is already reasonably accessible to you, whether free of charge or on payment of a fee.

Some of the information that you have requested is available online and the web links have been included as part of the enclosed information. Men and woman in each meeting While our aim is to provide information whenever possible, in this instance the Department does not hold or cannot, after taking reasonable steps to do so, find some of the information that you have requested. This is because the information relating to the number of men and woman at each meeting is not currently held by the Department. Where the data is not held in the format that has been requested section 8 (3) of the Freedom of Information Act 2015 states; Nothing in this Act requires a public authority to – (a) Create or derive information from information that it holds (b) Undertake research into, or analysis of, information that it holds. Names of attendees in each meeting I have enclosed copies of the information. Some information received in relation to the meetings that the Minister attended during the three lockdowns included people who no longer work for the Department and contained personal information and under section 25 of the Freedom of Information Act (absolutely exempt personal information) is exempt and has therefore been redacted. The reasons why that exemption applies are that: • the Department is satisfied that the information amounts to personal data of which you are not the data subject; and • the Department is satisfied that disclosure of the information would contravene one of the data protection principles as set out at Article 5 of the General Data Protection Regulation as it applies in the Isle of Man pursuant to The Data Protection (Application of GDPR) Order 2018, namely that the Department of Education Sport and Culture can only disclose the information where it would be fair, lawful and meet one of the conditions for lawful processing in Article 6 and in this case, none of those conditions have been met.
