Consultation summaries
The formal Notice proposing entry and a Building Preservation Notice were issued 22nd February 2021 and 15th December 2020 respectively. A Consultation report including facts about the building was produced and made available alongside the proposals to register notice. Statutory Consultees: Owner/Occupiers: The Agents working on behalf of the owners have provided comments. They object to the Registration and stated that, The cottages which make up the building are typical of a type found throughout the Island but with modern materials and additions as present, contribute to the building being of no special architectural interest. They are also in poor repair and have had alteration internally to enable the use as a single building. Its use as a café does not warrant it meeting the criteria of historic interest and there are better examples of café. Registration is being perused for public nostalgia reasons. Local Authority: The Local Authority are the Building owners and this fact must therefore be taken into consideration in their role as a statutory consultee and the conflict of interest. Manx National Heritage: Comments have yet to been received. Other organisations, groups Culture Vannin: Supports registration, and considers the building is important in social history terms due to its contribution to the seaside experience, its location and contribution to the proposed conservation area and as a vernacular building.
Isle of Man Antiquarian and Natural History Society (IMANHS): Supports registration, and considers the building to have an architectural style which is probably unique in the context of Port Erin and important to conserve. That it plays an important part of the street scene of Shore Road locality and old Port Erin separate from the post railway development at the top of the brooghs. The Cosy Nook’s builder, Watt, has important family associations with other properties in this locality. Subsequent owners and owner of several other properties in the locality include William H Milner. Rushen Heritage Trust: Supports registration, and considers the building to be of architectural interest as, was built in 1840 by the Watt fishing family, and the second was added in 1877. They also consider it to be of historic interest as an intrinsic part of St Catherine's Terrace, the most important heritage site in Port Erin. Port Erin began there. The frontage of the Cosy Nook is visible to people walking up St Catherine's Terrace and a significant heritage element in the Terrace. It has been important to both locals and tourists as a beachside and holiday venue. The building is certainly a rarity not only in the IOM but also in the British Isles, where it may be unique in its combination of heritage cottage building, outdoor beachside cafe, and location almost on the sandy beach. Members of the Public: 24 Members of the public have provided consultation responses all supporting the registration of the building, No additional unknown facts material to the case have been made.
Discussion
It is my view that the potential special interest of the building can be summarised by the following main issues; Age of the Building: The Age of the building has been stated as being prior to 1840 in some consultation responses including by IOMANHS. Whilst this is possible, there is insufficient direct evidence both architecturally and documentary to state this categorically. There is however, sufficient evidence to state that the buildings were constructed by the Watt’s family at some point during the mid-19th century and this is fully supported by the documentary evidence. In terms of age, the building falls within the category 1800-1860 that it may be worthy of registration and it is correct this building be assessed and considered. Extent of Alteration and Intactness: The building is clearly vernacular in style, construction and material and is without doubt a building that pre-dates the Village’s expansion as a tourist destination venue. The development of the Building is clear, in that, the larger cottage was built first, followed by the smaller cottage. The Building through change of use has lost its original plan form as it has been converted into one dwelling. In addition to this the building has also lost all internal features with the exception of the chimney breasts. The entire roof structure has been replaced and is less than 30yrs old, this replacement is not in traditional materials as artificial slates have been used and the roof structure is not representative of historic or traditional roof construction. IOMANHS and others have stated that the larger cottage was thatched, due to the survival slate weatherings upon a chimney stack, there is insufficient evidence again to state this categorically, there is no evidence of bwid suggane (pegs to tie the thatching rope down with) that have survived on other previously thatched buildings. The building has also lost historic windows and although in a traditional material (timber) the windows are of a non-historic type. The building has also been subject of a large single story flat roofed extension to the principle elevation. The external form of the building with the interference of the ground floor extension does still however reads as two cottages and still identifiable as a vernacular
building, that said, the extent of alteration and level of intactness are such that this building cannot be seen as nationally important example of vernacular dwelling houses of the mid-19th century. The alterations made to extend and enable the use of the two cottages as a Café are not of sufficient quality, technology or innovation to make them of architectural interest in their own right. Proposed Conservation Area: This issue has been raised in consultation comments a number of times that the building has been identified within the 2009 character area appraisal for the proposed conservation area, as making a positive contribution to it. This matter is not material to the suitability of the building for entry on to the protected buildings register, the test of which is that of special architectural or historic interest. Illustration of important aspects of the nation’s social, economic, or cultural, history: Taking into consideration the above, the core of the issue as to whether the building reaches the requirement of special interest would appear to be its significance in terms of its social and cultural history and how the building is an important illustration of that nationally. The building clearly demonstrates how its position, along the shore at port Erin Bay, was taken advantage of and converted to use as a café in the early 20th century. This was to benefit from the increase in tourism that the island had seen develop since the late 19th Century. Port Erin had particularly developed and grown as a direct result of coming on the railway and the increase in people visiting it as a destination. The building has in that context played a part in the experiences of people visiting the beach, and also holidaying on the island and in that sense has contributed to the cultural and social history of the Port Erin beachside. The building has been photographed, drawn and painted since the late 19th century at a personal level, not by any internationally renowned artists. The building despite its alterations is still identifiable as vernacular cottages in a shoreline location and has historic value in it representing the early village. The building’s form retains a quality of interest in the fabric that remains to connect to its past both as cottages and as a café. The building is clearly of high value locally both as a surviving building of the pre-tourist shoreline village and its social and cultural history as a venue associated with the village’s tourism. The key factor is does this sufficiently reflect special interest at a national level. I consider the merits of the Cosy Nook to be a borderline case. Having assessed the information I consider there to be sufficient information to support the proposed registration in accordance with the Department’s Operational Policy on the Principles of Selection for the Registration of Buildings in to the Protected Buildings Register.
Conclusion
After examining the available records and other relevant information, and having carefully considered the architectural and historic interest of this case, the criteria for entry to the Register of Protected Buildings are fulfilled and the Buildings Should be added to the Register.
Reasons for Registration Decision
The Cosy Nook, Port Erin, is recommended for entry into the Protected Buildings Register for the following reasons: ●HISTORIC INTEREST: • Age and rarity: surviving vernacular building of early Port Erin located in unique shoreline location. • The building is a surviving example of the adaptation of a vernacular building to accommodate the growing tourism industry, it is an example of the national story of the island’s development from rural life to tourist destination and associated social and cultural history.

3.2 Architectural Interest. The Cosy nook now a café originally two dwelling houses built on the shore at Port Erin Bay by the Watt family probably in the mid-19th century. The building is traditional Manx Vernacular in appearance small in scale and made of locally sourced material. The building has been heavily altered internally, the result of being made into a single unit, and its roof entirely replaced. Its windows have also been replaced. A single storey extension on the principle front elevation has also been added during the 20th century. 3.3 Historic Interest. Documentary research has revealed that in his will, (1876: May No 77) William Milner leaves cottages to the Watts provided they pay off debt they owed for occupying the property. The will clearly states that Milner had granted permission for the Watts to erect two cottages on his land. This land was purchased by Milner in 1861 after having previously rented this land from the Gawnes since 1856. Although there are other deeds and sales associated with the Watts family as there is no direct link to the existing buildings and given the statement in Millner’s will there is no conclusive evidence to date the buildings as existing pre 1856 although it is possible that the current buildings replaced earlier dwellings. The Building has been a café since the very early 20th century and is a surviving example of a vernacular dwelling, extensively altered for use a café during the rapid expansion of the island tourist boom. The Cosy nook is a café that was originally two dwelling houses built by the Watt family in the mid- 19th century. The buildings are Vernacular and traditionally Manx, small in scale and made of locally sourced material. The buildings have however been altered with loss of plan form, lack of intactness and wholesale roof replacement. A single storey extension to the principle elevation has significantly altered its appearance.
Recommendation
After examining the available information it appears that the building is likely to be of special architectural and historic interest and could meet the criteria of entry in to the Register of Protected Buildings.   1. Introduction and Purpose

1.1 The purpose of this paper is to seek endorsement of the recommendation report attached as appendix 1 and inclusion of the Cosy Nook on to the Protected Buildings Register.

  1. Background

2.1 The Department was asked to endorse the issuing of Proposal to Register notice on 3rd February 2021, which it did via the Department’s Policy and Strategy Meeting.

  1. Legal Issues

3.1 The means to designate Registered Buildings is set out within Section 14 of The Town and Country Planning Act 1999 which states:

14 The Protected Buildings Register

(1) The Protected Buildings Register, a register of buildings of special architectural or historic interest, previously maintained by the Department of Infrastructure, is to be maintained, after the coming into operation of the Transfer of Planning and Building Control Functions Order 2015, by the Department.

(2) In considering whether to enter a building in the register the Department may take into account not only the building itself but also —
(a) any respect in which its exterior contributes to the architectural or historic interest of any group of buildings of which it forms part; and
(b) the desirability of preserving, on the ground of its architectural or historic interest, any feature of the building consisting of a manmade object or structure fixed to the building or forming part of the land and comprised within the curtilage of the building.

(3) Schedule 2 shall have effect with respect to the compilation and amendment of the register.

3.2 The Procedure by which a Notice of Proposals to Register a Building is issued is set out within section 6 of the Town and Country Planning (Registered Buildings) Regulations 2013

6 Notice of proposal to register or de-register building

(1) The Department must give public notice of any proposal to register or to de- register a building in at least one newspaper published and circulating in the Island or by such other means as the Department considers appropriate —
(a) identifying the building in question, and

3 (b) stating that any person may make written submissions to the Department with respect to the proposal before such date as is specified in the notice (not being less than 21 days after the date on which the notice is first published).

(2) The Department must give a copy of the notice and state that written submissions with respect to the proposal may be made to the Department as directed under paragraph (1)(b) to —
(a) every owner or occupier of the building;
(b) the local authority for the district in which the building is situated; and
(c) Manx National Heritage.

(3) The Department must not register or de-register the building, as the case may be, until —
(a) it has considered any representation duly made in pursuance of a notice under paragraph (1) or (2); and
(b) the period referred to in paragraph (1)(b) has elapsed.

  1. Policy

4.1 The Policy context for Registration is outlined in the Department’s operational policy Principles of Selection for the Registration of Buildings in to the Protected Buildings Register attached as appendix 3.

  1. Assessment

5.1 An Advice Report has been prepared by the Registered Buildings Officer assessing the building’s potential special interest and outlining the comments received as part of the consultation. This report is attached as appendix 1; the comments received are attached as appendix 2.

  1. Justification for Proposed Registration

6.1 Officers are of the view that the Cosy Nook is of special architectural and/or historic interest and therefore is worthy of registration see appendix 1.

  1. Resource Issues 7.1 The proposed registration will be undertaken by the Department as part of its planning function.

  2. Options

8.1 Having considered the content of this report to support the addition of the building to the Protected Buildings Register or;

8.2 Not to proceed with the Registration.

9.1 Having considered the content of the advice report (as set out in appendix 1), and the comments (as set out in appendix 2), the building is considered of sufficient architectural and/or historic interest to warrant the inclusion on the Register by reason of: S14 of the Town and Country Planning Act 1999

10.1 The Department is recommended to agree the issue of a Notice of Registration to formally endorse the addition of the property to the Protected Buildings Register.

Context

Assessment Consultation summaries The formal Notice proposing entry and a Building Preservation Notice were issued 22nd February 2021 and 15th December 2020 respectively. A Consultation report including facts about the building was produced and made available alongside the proposals to register notice.

Statutory Consultees: Owner/Occupiers: The Agents working on behalf of the owners have provided comments. They object to the Registration and stated that, The cottages which make up the building are typical of a type found throughout the Island but with modern materials and additions as present, contribute to the building being of no special architectural interest. They are also in poor repair and have had alteration internally to enable the use as a single building. Its use as a café does not warrant it meeting the criteria of historic interest and there are better examples of café. Registration is being perused for public nostalgia reasons.

Local Authority: The Local Authority are the Building owners and this fact must therefore be taken into consideration in their role as a statutory consultee and the conflict of interest.

Manx National Heritage: Comments have yet to been received.

Other organisations, groups Culture Vannin:
Supports registration, and considers the building is important in social history terms due to its contribution to the seaside experience, its location and contribution to the proposed conservation area and as a vernacular building.

Isle of Man Antiquarian and Natural History Society (IMANHS): Supports registration, and considers the building to have an architectural style which is probably unique in the context of Port Erin and important to conserve. That it plays an important part of the street scene of Shore Road locality and old Port Erin separate from the post railway development at the top of the brooghs. The Cosy Nook’s builder, Watt, has important family associations with other properties in this locality. Subsequent owners and owner of several other properties in the locality include William H Milner.

Rushen Heritage Trust: Supports registration, and considers the building to be of architectural interest as, was built in 1840 by the Watt fishing family, and the second was added in 1877. They also consider it to be of historic interest as an intrinsic part of St Catherine's Terrace, the most important heritage site in Port Erin. Port Erin began there. The frontage of the Cosy Nook is visible to people walking up St Catherine's Terrace and a significant heritage element in the Terrace. It has been important to both locals and tourists as a beachside and holiday venue. The building is certainly a rarity not only in the IOM but also in the British Isles, where it may be unique in its combination of heritage cottage building, outdoor beachside cafe, and location almost on the sandy beach.

Members of the Public: 24 Members of the public have provided consultation responses all supporting the registration of the building, No additional unknown facts material to the case have been made.

Discussion It is my view that the potential special interest of the building can be summarised by the following main issues;

Age of the Building: The Age of the building has been stated as being prior to 1840 in some consultation responses including by IOMANHS. Whilst this is possible, there is insufficient direct evidence both architecturally and documentary to state this categorically. There is however, sufficient evidence to state that the buildings were constructed by the Watt’s family at some point during the mid-19th century and this is fully supported by the documentary evidence. In terms of age, the building falls within the category 1800-1860 that it may be worthy of registration and it is correct this building be assessed and considered.

Extent of Alteration and Intactness: The building is clearly vernacular in style, construction and material and is without doubt a building that pre-dates the Village’s expansion as a tourist destination venue. The development of the Building is clear, in that, the larger cottage was built first, followed by the smaller cottage. The Building through change of use has lost its original plan form as it has been converted into one dwelling. In addition to this the building has also lost all internal features with the exception of the chimney breasts. The entire roof structure has been replaced and is less than 30yrs old, this replacement is not in traditional materials as artificial slates have been used and the roof structure is not representative of historic or traditional roof construction. IOMANHS and others have stated that the larger cottage was thatched, due to the survival slate weatherings upon a chimney stack, there is insufficient evidence again to state this categorically, there is no evidence of bwid suggane (pegs to tie the thatching rope down with) that have survived on other previously thatched buildings. The building has also lost historic windows and although in a traditional material (timber) the windows are of a non-historic type. The building has also been subject of a large single story flat roofed extension to the principle elevation. The external form of the building with the interference of the ground floor extension does still however reads as two cottages and still identifiable as a vernacular building, that said, the extent of alteration and level of intactness are such that this building cannot be seen as nationally important example of vernacular dwelling houses of the mid-19th century.
The alterations made to extend and enable the use of the two cottages as a Café are not of sufficient quality, technology or innovation to make them of architectural interest in their own right.
