Dear ###
We write further to your request which was received on 12 April 2021 and which states:
"Hi, can I request the following thank you 1. Does the Isle of Man follow the Halsbury laws of England. 2. Are the courts of justice an administrative courts 3. Can you pro-vide a link for all information on the settlement act 1707/1777. 4. What documentation do we need to present for private prosecutions for the cps."
While our aim is to provide information whenever possible, in this instance the Attorney General’s Chambers, after taking reasonable steps to do so, can provide some of the information that you have requested. For ease, we have broken down your questions which I have detailed the information that is held: Our Response: Question 1: “Does the Isle of Man follow the Halsbury laws of England”. Halsbury’s Laws of England is a series of volumes published by LexisNexis which states the law of England and Wales. It is not Isle of Man “law” and as such cannot be said to be “followed” although it may be frequently referenced. Question 3: “Can you pro-vide a link for all information on the settlement act 1707/1777”. In answer to question 3, all of the primary legislation currently in force is available on the legislation website at https://legislation.gov.im/cms/ There is not a current Act entitled the ”Settlement Act” in 1707, 1777 or any other year. There is an Act of Settlement in 1704 and an Act of Settlement (Further Provisions) Act 1704 which can be accessed at: https://legislation.gov.im/cms/images/LEGISLATION/PRINCIPAL/1704/1704- 0001/ActofSettlement1704_1.pdf https://legislation.gov.im/cms/images/LEGISLATION/PRINCIPAL/1704/1704- 0002/ActofSettlementFurtherProvisionsAct1704_1.pdf
Older repealed Acts will be held in hard copy at the Tynwald reference library. For legislation queries the Tynwald library may be able to assist. 01624 685520 or email: library@tynwald.org.im Questions 2 and 4: 2. “Are the courts of justice an administrative courts”. 4. “What documentation do we need to present for private prosecutions for the cps". Whilst the Attorney General's Chambers maintains the legislation website and provides legal advice to the Isle of Man Government we are unable to provide legal advice to members of the public. If you wish to consult a Manx advocate the Isle of Man Law Society should be able to provide you with suitable contact details.
