As the appellant for this appeal, I require all correspondence concerning the demonstration of absence of a conflict of interest concerning the appeal decision for PA 19/01441/B. I would be grateful if this information is provided by 5 Feb 2021 at the latest, so that it can be taken into account before the elapse of the 3- month period since the appeal decision was made (12 Nov 2020)

We write further to your request which was received on 18 January 2021 and which states:

"As the appellant for this appeal, I require all correspondence concerning the demonstration of absence of a conflict of interest concerning the appeal decision for PA 19/01441/B. I would be grateful if this information is provided by 5 Feb 2021 at the latest, so that it can be taken into account before the elapse of the 3- month period since the appeal decision was made (12 Nov 2020)" You then clarified this request as below: “Concerning my previous information request 1634621, I clarify that the scope of this request covers all documentation (including correspondence) relating to conflict of interest for the appeal decision PA/01441/B” (Note - this clarification was logged with the reference 1634921.) Response There is no requirement to declare or demonstrate an “absence of conflict of interest”. Consequently this information is not held. Further information Officers of the Planning & Building Control Directorate are required to declare an interest, or where one may be perceived, in any planning application, and are required to record that interest. The Department retains a file of the memorandum where such interest is declared. No staff member has recorded an interest in this application. This application was determined at a public meeting of the Planning Committee 2nd March 2020. The criteria for declaring an interest for members of the Planning Committee is set down in their Standing Orders. The Department’s decision in the matter was challenged at appeal. The Minister declared a ‘conflict of interest’ in the application and the appeal decision was delegated for determination for the Department by Mr R Callister, MHK.
