The requester asked if animal health legislation prohibits importing red-necked wallabies from the UK to the Isle of Man. Dear ###

We write further to your request which was received on 11 January 2021 and which states:

"are there any regulations under animal health legislation that would prohibit my importation of red necked wallabies (macropus rufogriseus) from the uk"

The Department are not aware of any regulations under animal health legislation that would prohibit the importation of red necked wallabies from the UK. However the importation of wallabies would be subject to the conditions of an export certificate issued by the exporting country in agreement with the Island. In relation to your question it is of significance that there is not currently an agreed export certificate with the United Kingdom. It is important to note that even if it were possible to arrange for an export certificate with the United Kingdom, that there is other relevant legislation that would be relevant to a keeper of animals of this nature, that may determine if and how they could be kept. As a starting point it would be imperative that someone undertaking to seek to import and ‘keep’ non-native species such as red neck wallabies should familiarise themselves with the following legislation which, amongst other regulations, would be of relevance; • Wild Animals (Restriction on Importation) Act 1980 http://www.legislation.gov.im/cms/images/LEGISLATION/PRINCIPAL/1980/198 0-0004/WildAnimalsRestrictiononImportationEtc.Act1980_1.pdf • Endangered Species Act 2010 https://legislation.gov.im/cms/images/LEGISLATION/PRINCIPAL/2010/2010- 0007/EndangeredSpeciesAct2010_4.pdf • Destructive Imported Animals Act 1963 https://legislation.gov.im/cms/images/LEGISLATION/PRINCIPAL/1963/1963- 0005/DestructiveImportedAnimalsAct1963_1.pdf • Wildlife Act http://www.legislation.gov.im/cms/images/LEGISLATION/PRINCIPAL/1990/199 0-0002/WildlifeAct1990_3.pdf • Animal Health Act 1996
