Dear ### We write further to your request, which was received on 14 September 2020 and in accordance with Decision Notice 2021/0002 issued by the Information Commissioner’s Office on 01 March 2021. Your request stated: Please could you supply the following information: (1) What is the tendering process for the transport & supply of the Calf of Man seasonal wardens? (2) What is the frequency of the tendering process? (3) What was the date of the last tender? (3) How much has MNH paid annually for such services over the past 10 years? The first 3 requests were answered in previous correspondence dated 08 October 2020, however I have included those responses below for completeness.
(1) What is the tendering process for the transport & supply of the Calf of Man seasonal wardens? The provision of transport services to the Calf has been a long standing arrangement and has not gone through a recent tendering process. However this is currently under review with the expectation that it will be advertised on the Government’s procurement portal in due course.

(2) What is the frequency of the tendering process? There is an ongoing review of the service and we anticipate that it will go through the tender process shortly with a likely contract length of 3-5 years.

(3) What was the date of the last tender? Information not held - it has not gone through a tender process.

(4) How much has MNH paid annually for such services over the past 10 years? The right of access to information under the Freedom of Information Act applies to information created on or after 11 October 2011 and as the information for financial year 2010/11 was created before this date, it does not fall under the scope of the Act. Manx National Heritage has considered your request and agreed to make the information available outside of the scope of the Freedom of Information Act.

Specific Issues you raised You informed us that you were unhappy with some of the reasoning given for non- disclosure.

Decision The final decision of this review was that the response provided by relevant colleagues concluded that the exemptions were applied appropriately under the Freedom of Information procedure. The Service of the FoI request is due to be Tendered in the next few weeks and pertinent information regarding the requirements of the Service will be published on the Isle of Man Government Portal at that time. However it has now been agreed that details of trips made are provided to you now and these are set out below. As noted this information will also be provided in the tender details for all potential bidders to inform their bid.

Our response to your request is as follows: (1)What is the tendering process for the transport & supply of the Calf of Man seasonal wardens? The provision of transport services to the Calf has been a long standing arrangement and has not gone through a recent tendering process. However this is currently under review with the expectation that it will be advertised on the Government’s procurement portal in due course. (2) What is the frequency of the tendering process? There is an ongoing review of the service and we anticipate that it will go through the tender process shortly with a likely contract length of 3-5 years. (3) What was the date of the last tender?
Information not held - it has not gone through a tender process. (3) How much has MNH paid annually for such services over the past 10 years?" While our aim is to provide information whenever possible, in this instance we are unable to provide the information you have requested because it is absolutely exempt under section 25 of the Act (absolutely exempt personal information). The reasons why that exemption applies are that: • Manx National Heritage is satisfied that the information amounts to personal data of which you are not the data subject; and

• Manx National Heritage is satisfied that disclosure of the information would contravene one of the data protection principles as set out at Article 5 of the General Data Protection Regulation as it applies in the Isle of Man pursuant to the Data Protection (Application of GDPR) Order 2018, namely that Manx National Heritage can only disclose the information where it would be fair, lawful and meet one of the conditions for lawful processing in Article 6 and in this case, none of those conditions have been met. In addition, the information is exempt from disclosure under section 30 of the Act as disclosure is likely to prejudice the commercial interests of a person (including the public authority holding it). As section 30 is a qualified exemption, it was subject to a public interest test. The public interest must be something that is of serious concern and benefit to the public at large.

Factors in favour of disclosure Promotes transparency and accountability in the expenditure of a Public Authority

Factors in favour of withholding Qualified exempt information – see above Disclosure would prejudice the commercial interests of the supplier Disclosure would prejudice the tendering process affecting the interest of Manx National Heritage Releasing the information could damage relationships between Manx National Heritage and its suppliers threatening its position to obtain suppliers of services.

In taking these factors into account the Manx National Heritage determined that the factors in favour of maintaining the exemption outweigh the factors in favour of disclosing the information.
