We write further to your request which was received on 13th August 2020 and which states:
"Question 1:
In the past 5 years, how many times have hospital employees been discovered to have accessed patients' data that they were not supposed to or authorised to do so (i.e. the patient was not under their treatment plan)? Question 2: Of those cases how many were (i) doctors/consultants and (ii) other staff (nurses etc.)? Question 3: How many (i) doctors/consultants and (ii) other staff were dismissed in such cases?"
Response to your request Question 1 In the past 5 years, how many times have hospital employees been discovered to have accessed patients' data that they were not supposed to or authorised to do so (i.e. the patient was not under their treatment plan)? In the past five (5) years there have been two (2) employees that have accessed patients’ data when they have not been entitled to.
Question 2: Of those cases how many were (i) doctors/consultants and (ii) other staff (nurses etc.)? While our aim is to provide information whenever possible, in this instance we are unable to provide the information you have requested; the Department of Health and Social Care does not hold the information that the applicant has requested (section 11(3)(a) of the Act). Question 3: How many (i) doctors/consultants and (ii) other staff were dismissed in such cases? In the past five (5) years there have been no hospital employees dismissed for accessing patients’ data when they have either not supposed to or authorised to do so. Please quote the reference number 1421153 in any future communications.
