Have you carried out an equality impact assessment in relation to your decision to remove the Promenade walkway as available parking for residents of Loch Promenade during the remainder of the promenade refurbishment scheme. If so can you please provide a copy of that assessment. 2. I would like to see all documentation relating to discussions and considerations around accommodating the needs of residents with mobility issues 3. Have you an updated impact assessment (the version currently published on the My Prom website is now out of date as makes reference to Promenade walkway parking as mitigation for the impact on disabled residents).

We write further to your request which was received on 5 June 2020 and which states (sic):

"1. Have you carried out an equality impact assessment in relation to your decision to remove the Promenade walkway as available parking for residents of Loch Promenade during the remainder of the promenade refurbishment scheme. The answer to your questions are as follows: 1. No. An equality impact assessment has not been carried out as there is not normally parking available on the Promenade Walkway. This is in line with the Department’s practice on equality impact assessments for maintenance. 2. Please see Appendix 1 You will see that we have redacted some information which is exempt under s25 (absolutely exempt personal information) of the Act. The Department is satisfied that this information amounts to personal data of which you are not the data subject; and that disclosure of the information would contravene one of the data protection principles as set out in Article 5 of the General Data Protection Regulation as it applies in the Isle of Man pursuant to the Data Protection (Application of GDPR) Order 2018, namely that the Department of Infrastructure can only disclose the information where it would be fair, lawful and meet one of the conditions for lawful processing in Article 6 and in this case, none of those conditions have been met.

3. Under s20 of the FOI Act, we are not required to provide information in response to a request if it is already reasonably accessible to you. In this instance, the Promenade impact assessment is currently being updated and will be published on the MyProm Website in due course.
