Original Request

I request a copy of the policy paper and all/any internal emails and papers regarding the recent decision to close off the area of land at Cross Vein Mine known as Snuff the Wind. I also request a copy of any relevant section of a report that provide evidence that people's health have been proven to have suffered by using the land at Cross Vein Mine. I also request a copy of the report that shows evidence the pollution alleged in Peel harbour silt and the lower River Neb has specifically come from the area of Cross Vein Mine and the evidence that riding on this land has caused this. Please provide all documentation on record regarding Cross Vein Mine and in particular details of what has been dumped (or believed by Government to have been dumped) down redundant mine shafts in the entire area.

Factors in favour of disclosure  There is a general public interest in knowing why government has made its decisions and what considerations took place prior to those decisions.  There is a public interest in wide scrutiny of the evidence that was behind government decisions. Factors in favour of maintaining the exemption  Disclosure would be likely to adversely affect the breeding sites of birds by making the locations of those sites publically available. The Department has weighed the factors for and against release of this information and has determined to withhold this information in the interests of wildlife conservation generally and in the conservation of the species concerned particularly. Further Information In addition to the paper submitted to the DEFA Policy & Strategy Committee on the 6th November 2019 (Q1 P_S Paper) noted above we would also offer you the minute from that meeting, below:

Question 2 “I‎also‎request‎a‎copy‎of‎any‎relevant‎section‎of‎a‎report‎that‎provide‎evidence‎that‎ people's health have been proven to have‎suffered‎by‎using‎the‎land‎at‎Cross‎Vein‎Mine.” This information is not held. Further information Some data is contained within the document in response to Q.1 (P_S Paper) outlining the acceptable levels of minerals in samples and the recorded levels of minerals found at various sites, as a result of land disturbance. Question 3 “I‎also‎request‎a‎copy‎of‎the‎report‎that‎shows‎evidence‎the‎pollution‎alleged‎in‎Peel‎ harbour silt and the lower River Neb has specifically come from the area of Cross Vein Mine‎and‎the‎evidence‎that‎riding‎on‎this‎land‎has‎caused‎this.”

Morning ,

Prior to Christmas and I discussed either restricting access to or erecting warning signs at the planned remediation site. This followed the statement posted on the DOI Facebook page by a member of the public stating that we know the area is contaminated, but have done nothing to restrict access.

informed me that the from a SMT perspective signage was thought to be more appropriate than complete exclusion in the first instance. I’m happy to go with that, but if I’m honest I have never seen any specific data apart from water samples that indicates what harmful substances are present. Whilst I support restricting access and signage I currently don’t feel that the FALD team are qualified to warn people away from something that we have no data for. Going forward I’m more than happy to organise the erection of signs, but would like some clarification on the following:

• Who is the ‘keep off’ message from and what contact details should be put on the signs? 2 • What contaminants and what data can we refer any disgruntled users to? • What should the signs say? • What do we say when people ask why we have only just acted on this now? • As soon as any sign is erected we are basically telling people to keep off and as such anyone who ignores the signs will be in breach of Section 28 of the Highways Act as well as the Forestry Act – Will it be left to FALD to then monitor the site and prosecute? • If the last point is valid, would it not just be easier to fence the area off to avoid officer time and prosecutions?

As you know am fully aware that the site is contaminated, but I have never seen any information about any site sampling

I’ve copied in as whilst we have never promoted the recreational use of the area any future restrictions will no doubt create extra work for him.

Hi ,

Terrific, if you can advise on whether HM concentrations are too toxic for plant growth this will be important to understand the feasibility of this project. from Wardell Armstrong did suggest that it may be an opportunity to first treat the contaminated soil / spoil heaps at Cross Vein Mine to reduce HM concentrations, nuggets of HM ore had been observed when walking over the site, possibly dropped during historic transport. This could both benefit Phase 2 reducing contamination at source and Phase 1B in making the site more suitable for habitat restoration. However, the obvious drawback is additional cost unless there was some value in the metals removed. recently employed a company I think from Norway to excavate the IBA from Old Turkeylands and remove the metals before depositing in New Turkeylands; apparently the money made from recovery of the metals paid for the project although this was metal not ore and did include small amounts of precious metals.

Yes we can do that, other than that total nitrogen will be by Kjeldahl not Dumas (Dumas is a rapid method using an expensive instrument we don’t have, Kjeldahl is the reference method against which Dumas is commonly assessed), and we have no idea of what exactly is meant by “hand soil texture” so we can’t do that.

I would observe, however, that if the heavy metal content makes the present soil too toxic for plant growth, the levels of plant nutrients in it are rather academic, whatever levels the Marina silt to be put there may contain.

As discussed I have now gathered 12 soil samples from Cross Vein Mine from locations as in attached sampling plan, will drop them in tomorrow about 9.30am.

Please can these be analysed for Metals and if not too much of an inconvenience parameters recommended in the Natural England Technical Information Note TIN035 Soil sampling for habitat recreation and restoration, which would be a bonus:

• pH(water) • available phosphorus (P) using he Olsen method • available potassium (K) • available magnesium (Mg) • total nitrogen (N) using the Dumas method • a hand soil texture • the P, K and Mg results should be quoted in milligrams/litre

My proposal is to provide the results to the contractor when appointed by the DoI for phase 1B to assist in the initial determination of how reasonable and practicable it would be to utilise the Peel Dredging Spoil for remediation of Cross Vein Mine Site.
