We write further to your request which was received on 27 November 2019 and which states:
"I request for the key stage 2 national curriculum levels for all the children currently in year 6 at Rushen primary school. I would like the levels for each child, for each year."
In order to identify and locate the information that you asked for, we needed to clarify if the request is referring to the attainment levels for each year 6 pupil since the beginning of key stage 2 at Rushen Primary. You advised: I would like the attainment levels for each child currently in year six at Rushen primary school since the beginning of key stage 2. Our response to your request is as follows: I have enclosed copies of the information that is being released to you. By way of advice and assistance the information enclosed is for each child in the current year 6 cohort since the beginning of key stage 2 to the end of year 5 in English, Maths and Science and is in no particular order. Also the information includes leavers and new starters to the year 6 cohort, therefore the number of pupils in each academic year fluctuates. Some of the information including names and individual attainment levels within the information enclosed has been removed/redacted because it is absolutely exempt under section 25 (2) (a) and (b) (i) of the Act (absolutely exempt personal information). The reasons why this exemption applies is that: • The Department is satisfied that the information amounts to personal data of which you are not the data subject; and • The Department is satisfied that disclosure of the information would contravene one of the data protection principles as set out at Article 5 of the General Data Protection Regulation as it applies in the Isle of Man pursuant to the Data Protection (Application of GDPR) Order 2018, namely that the Department of Education Sport and Culture can only disclose the information where it would be fair, lawful and meet one of the
conditions for lawful processing in Article 6 and in this case, none of those conditions have been met.
